1. Acceptance of Terms

By downloading, installing, accessing, or using the FileDrop mobile application or the FileDrop website at filedrop-site.pages.dev (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must immediately stop using the Service. Your continued use of the Service after any modification to these Terms constitutes your acceptance of those changes.

These Terms constitute a legally binding agreement between you ("User") and FileDrop ("we", "us", "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description & Limits

FileDrop is a free, temporary file-sharing service. It allows users to:

• Upload files and receive a unique 6-character share code.
• Share that code with anyone who can use it to download the file.
• View, manage, and delete recent uploads from the "My Uploads" screen.
• Download files shared by others by entering a valid code.

The Service is subject to the following technical limits, which may be changed at any time:

Files that reach either the download limit or the time limit are automatically and permanently deleted, whichever occurs first.

3. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use FileDrop. By using the Service, you represent and warrant that you meet this age requirement. If you are under the applicable minimum age, you must not use the Service.

You are also prohibited from using the Service if you have previously been banned due to a violation of these Terms.

4. Acceptable Use

You agree to use FileDrop only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You are solely and fully responsible for all files you upload and all activity that occurs in connection with your use of the Service.

Acceptable uses include:

• Sharing personal files (photos, videos, documents, audio) with friends, family, or colleagues.
• Transferring work files between your own devices.
• Sending files as part of legitimate professional, educational, or creative collaboration.
• Any lawful file transfer that respects the rights of others.

You agree not to:

• Use automated tools, bots, or scripts to upload, download, or access the Service at a rate exceeding normal human usage.
• Attempt to circumvent usage limits through technical means (e.g., spoofing device IDs).
• Reverse-engineer, decompile, or attempt to access the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Attempt to gain unauthorized access to the Service or related systems.
• Use the Service in any way that could impose an unreasonable load on our infrastructure.

5. Prohibited Content & Activities

The following types of content are strictly prohibited on FileDrop. You must not upload, share, or distribute files that:

• Malware & malicious code: Viruses, worms, trojans, ransomware, spyware, adware, or any software designed to harm devices or users.
• Illegal content: Any content that is illegal under applicable law, including but not limited to stolen data, contraband, or content that violates export control laws.
• Child sexual abuse material (CSAM): Any content that sexually exploits minors. This is our most serious prohibited category — we will report such content to the National Center for Missing & Exploited Children (NCMEC) and cooperate fully with law enforcement.
• Copyright infringement: Pirated software, movies, music, books, or any copyrighted material you do not have the right to distribute.
• Harassment & threats: Content used to harass, bully, threaten, or intimidate any individual or group.
• Fraud & phishing: Content designed to deceive users, steal credentials, or facilitate financial fraud.
• Privacy violations: Content that exposes the personal information of others without their consent (doxing).
• Hate speech: Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Dangerous content: Instructions for manufacturing weapons, explosives, or other materials intended to cause harm.

We reserve the right — but not the obligation — to monitor uploaded content and to remove or disable access to any content that we believe, in our sole discretion, violates these Terms.

6. Content Ownership & License

You retain full ownership of all files you upload to FileDrop. We do not claim any rights over your content.

By uploading a file, you grant FileDrop a limited, temporary, non-exclusive, royalty-free license to:

• Store the file on our infrastructure.
• Deliver the file to recipients who access it via the share code.
• Perform technical operations necessary to provide the Service (e.g., integrity checks).

This license is automatically and permanently revoked when the file is deleted (whether manually, by expiry, or by download limit). We do not retain any copies after deletion.

You represent and warrant that:

• You own or have the necessary rights and permissions to upload and share the file.
• The file does not violate any third party's intellectual property, privacy, or other rights.
• The file complies with all applicable laws.

7. Service Availability

FileDrop is provided on an "as-is" and "as-available" basis. We make no guarantees regarding:

• Uptime, availability, or uninterrupted access to the Service.
• That files will be retained for the full 24-hour period — files may be deleted earlier due to maintenance, technical errors, or policy violations.
• That the Service will be available in its current form indefinitely.
• That the Service will be free of charge permanently.

We may modify, suspend, or permanently discontinue the Service (or any part of it) at any time without notice and without liability to you. We may also introduce new features, change existing features, or remove features at our discretion.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FILEDROP AND ITS OPERATORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
• WARRANTIES OF NON-INFRINGEMENT.
• WARRANTIES THAT THE SERVICE WILL BE SECURE, ACCURATE, COMPLETE, RELIABLE, TIMELY, OR FREE FROM ERRORS OR VIRUSES.
• WARRANTIES THAT DEFECTS IN THE SERVICE WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties; in such cases, the above exclusions apply to the fullest extent permitted by law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FILEDROP, ITS OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES.
• COST OF SUBSTITUTE GOODS OR SERVICES.
• ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR FILES.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

Since FileDrop is free, this effectively limits our liability to $10.

10. Indemnification

You agree to defend, indemnify, and hold harmless FileDrop and its operators from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service.
• Any files you upload, including any claims that your content infringes a third party's rights.
• Your violation of these Terms.
• Your violation of any applicable law or third-party right.

11. Copyright & DMCA

FileDrop respects intellectual property rights. If you believe that content available through the Service infringes your copyright, please send a notice to legal@filedrop.app with the following information:

• A description of the copyrighted work you claim has been infringed.
• The share code or URL of the allegedly infringing content.
• Your contact information (name, address, email).
• A statement that you have a good-faith belief that the use is not authorized.
• A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

We will review valid DMCA notices and remove infringing content promptly. Note that given files expire within 24 hours, most content will already be deleted by the time we receive a notice.

12. Termination & Enforcement

We reserve the right to restrict or terminate access to the Service — without notice and at our sole discretion — for any user who:

• Violates any provision of these Terms.
• Uploads illegal or prohibited content.
• Engages in abusive, fraudulent, or disruptive behavior.
• Attempts to overwhelm, circumvent, or exploit the Service.

Since FileDrop has no accounts, access restriction is enforced at the network level (IP blocking or device-ID blocking). Termination does not relieve you of any obligations that arose before termination, including indemnification obligations.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or a court of competent jurisdiction, as appropriate under applicable law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. It is your responsibility to check this page periodically for changes.

Material changes (those that significantly affect your rights) will be clearly noted. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
